Here we inform you in detail about how we handle your data when you visit our website, when ordering goods and services, and when using them.
1. Access data and hosting
You can visit our website without providing any personal information. On each call of a web page, the web server automatically stores a so-called server logfile, which may contain, for example, the name of the requested file, your IP address, the date and time of the request, the amount of data transferred and the requesting provider (access data) and documents the request.
These access data are evaluated exclusively for the purpose of ensuring a trouble-free operation of the website and of improving our offering. In accordance with Article 6(1) sentence 1 lit. f of the GDPR, this serves to safeguard our legitimate interests which prevail within the scope of a balancing of interests in the correct presentation of our offering. All access data will be deleted at the latest seven days after the end of your visit to the site.

Within the scope of processing on our behalf, a third-party provider performs the services for hosting and presenting the website. This serves to safeguard our legitimate interests prevailing within the scope of a balancing of interests in the correct presentation of our offering. All data collected in the course of using this website or in designated forms in the online shop as described below are processed on its servers. Processing on other servers takes place only to the extent described here.
This service provider is located within a country of the European Union or the European Economic Area.
2. Collection and use of data for contract processing and contact
We collect personal data when you voluntarily provide it during your order or when contacting us (e.g., via contact form or e-mail). Mandatory fields are marked as such, since in these cases we require the data for contract processing or for handling your contact request, and without providing them it is not possible to submit the order or the contact request. Which data are collected can be seen from the respective input forms. We use the data you provide according to Article 6(1) sentence 1 lit. b of the GDPR for contract processing and handling your inquiries. If you have given your consent pursuant to Article 6(1) sentence 1 lit. a of the GDPR by choosing to open a customer account, we use your data for the purpose of opening the customer account. After full settlement of the contract or deletion of your customer account, your data will be restricted for further processing and deleted after the expiry of tax and commercial retention periods, unless you have explicitly consented to further use of your data or we reserve further use of data permitted by law and inform you about it in this declaration. Deletion of your customer account is possible at any time and can be carried out either by a message to the contact option described below or via a function provided in the customer account.
In case of a contract conclusion we store the following personal data in order to fulfill the contract:

* Telephone number

* Address: street, house number, city, country

* Information about the installed energy storage systems: item, serial number, configuration, inverter, etc., as well as basic technical data.

Transmission of your data to us
You can submit personal data to us for service purposes in the following ways:
1. By independently registering your data when opening a service ticket on our online platform.

2. By providing your data to our service employees when you call our service telephone numbers in Europe. The service employee then stores these data in our database.

3. By independently registering your data to download presentations prepared by our service team at events across Europe. Before downloading you must provide your contact details (full name and e-mail address).

These storages take place in accordance with Article 6(1) sentence 1 lit. b of the GDPR for the purpose of contract fulfillment.
Telephone recordings for quality purposes
To ensure and improve our service quality, we record telephone conversations with our customer service employees. Recording is done exclusively for internal training and quality assurance purposes. The legal basis is Article 6(1) sentence 1 lit. f of the GDPR, since we have a legitimate interest in optimizing our customer service. Prior to each call you will be informed about the recording and have the opportunity to object. Recordings are treated confidentially and deleted no later than 90 days, unless longer storage is required to clarify a specific matter.
Data collection in case of malfunctions
If an energy storage system fails, we extract data from the system itself (SOC, charge and discharge kilowatt hours for a certain period, etc.) to analyze them in special applications and identify the problem. These data are pseudonymous because they are linked exclusively to the serial numbers of the system/module. They are not attributed to specific persons. No data about the system itself (location, owner, etc.) are collected. These technical data may, in some cases, be passed on to BYD technical support. Here again, the linkage is made exclusively via serial numbers.
3. Data disclosure
For contract fulfillment pursuant to Article 6(1) sentence 1 lit. b of the GDPR, we pass on your data to the shipping company commissioned with delivery insofar as this is necessary for the delivery of ordered goods. Depending on which payment service provider you select in the order process, we transfer the payment data collected for the processing of payments to the credit institution commissioned with the payment and, where applicable, to payment service providers engaged by us or to the selected payment service. In part, the selected payment service providers also collect these data themselves if you create an account with them. In this case you must log in with your access data at the payment service provider during the ordering process. The privacy policy of the respective payment service provider applies accordingly.
The same applies to the disclosure of data to our manufacturers or wholesalers in cases where they take over shipping for us (drop shipment).
You can contact us as a purchaser of our products for customer service and technical support. These contacts take place mainly by telephone and e-mail and by direct registration on our support platform on the Internet (https://support.eft-systems.de/login). In addition, we offer training on the various products mentioned above as part of special events throughout Europe. At the end of each event, customers can register their data on a landing page to download presentation materials (data sheets, PowerPoint presentations, PDFs, etc.). The data that customers provide to us in this way are stored by us for the purposes of the services mentioned. The legal basis for this is Article 6(1) sentence 1 lit. b of the GDPR.
Disclosure of data to shipping service providers
If you have given us your explicit consent to do so during or after your order, we will pass on your e-mail address to the selected shipping service provider on the basis of this consent pursuant to Article 6(1) sentence 1 lit. a of the GDPR so that it can contact you prior to delivery for delivery notification/coordination.
The consent may be revoked at any time by a message to the contact option described below or directly to the shipping service provider at the contact address stated below. After revocation we will delete the data you provided for this purpose, unless you have expressly consented to further use of your data or we reserve further use of data permitted by law and inform you about it in this declaration.
4. E-mail newsletter
E-mail advertising with newsletter subscription
If you subscribe to our newsletter, we use the data required for this or separately provided by you to regularly send you our e-mail newsletter on the basis of your consent pursuant to Article 6(1) sentence 1 lit. a of the GDPR.
These newsletters are sent by EFT-Systems GmbH and by other companies in the same industry (i.e., inverter manufacturers). This means that, with your prior consent, we also wish to send messages from this industry, including EFT, BYD and other commercial partners, which will always be related to renewable energies.
You can unsubscribe at any time either by sending a message to the contact option described below or via the link provided in the newsletter. After unsubscribing we will delete your e-mail address unless you have expressly consented to further use of your data or we reserve further use of data permitted by law and inform you about it in this declaration.
5. Cookies and web analysis
In order to make the visit to our website attractive and to enable the use of certain functions, as well as to display suitable products or for market research purposes, we use so-called cookies on various pages, provided you have given your consent in accordance with Article 6(1) sentence 1 lit. a of the GDPR.

Use of Google (Universal) Analytics for web analysis
If you have given your consent in accordance with Article 6(1) sentence 1 lit. a of the GDPR, this website uses Google (Universal) Analytics for the purpose of website analysis. The web analysis service is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (www.google.de). Google (Universal) Analytics uses methods that enable an analysis of your use of the website, such as cookies. The automatically collected information about your use of this website is generally transmitted to and stored on a Google server in the United States. By enabling IP anonymization on this website, the IP address is shortened within member states of the European Union or in other signatory states to the Agreement on the European Economic Area prior to transmission. Under this agreement between the USA and the European Commission, the latter has determined that companies certified under Privacy Shield provide an adequate level of data protection.

6. Mobile App
BYD is launching a new platform which can be used via a mobile app. The purpose of this app is to simplify the installation of batteries in private PV + battery systems.
With the introduction of this new platform, additional functions such as loyalty programs and online training programs will also be offered.
Only the data of those customers who have previously consented to the transfer of their registration data will be shared into the BYD customer database and a unified authentication method will be introduced in the future.
This will allow customers to access all functions (from installation to customer service) with a single login and password.
BYD's server is located in France.
7. Contact options and your rights
You have the following rights with regard to your personal data; you can reach us, among others, via the contact details given in § 1 para. 2 to exercise these rights:
1. Right to object (Art. 7 GDPR)
If we process your personal data for direct marketing, you have the right to object at any time with effect for the future to the processing of personal data concerning you for such advertising; this also applies to profiling insofar as it is related to such direct marketing. You also have the right to object at any time for reasons arising from your particular situation to the processing of personal data concerning you which is carried out pursuant to Article 6(1) sentence 1 lit. e or f of the GDPR; this also applies to profiling based on those provisions. The right to object may be exercised free of charge.

2. Right of access (Art. 15 GDPR)
You have the right at any time to request confirmation from us as to whether personal data concerning you are being processed, and where that is the case, to request access to the personal data and the other information referred to in Art. 15 GDPR.

3. Right to rectification (Art. 16 GDPR)
You have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you (Art. 16 GDPR). In consideration of the purposes of the processing, you have the right to obtain the completion of incomplete personal data—also by providing a supplementary statement.

4. Right to erasure ("right to be forgotten") (Art. 17 GDPR)
You have the right to obtain from us the erasure of personal data concerning you without undue delay where one of the grounds in Art. 17(1) GDPR applies and the processing is not necessary for the purposes set out in Art. 17(3) GDPR.

5. Right to restriction of processing (Art. 18 GDPR)
You may request restriction of processing of your personal data where one of the grounds in Art. 18(1)(a)–(d) GDPR applies.

6. Right to data portability (Art. 20 GDPR)
Under the conditions set out in Art. 20(1) GDPR you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format and you have the right to transmit those data to another controller without hindrance from us. In exercising your right to data portability, you also have the right to have the personal data transmitted directly from us to another controller where technically feasible.

7. Right to withdraw consent (Art. 7 GDPR)
If processing is based on your consent, you have the right to withdraw your consent at any time. The lawfulness of processing carried out on the basis of consent before its withdrawal is not affected.
